Welcome to TMCH Podcast (hereinafter "the Site"). By accessing and using this website, you agree to comply with the following terms and conditions. If you do not agree with any of these terms, please do not use our services.

1. General Information

The Site is operated by TMCH Viajes — Uruguay. By accessing any section of the Site, including the Studio section with paid digital products, you agree to be bound by these Terms and Conditions. We reserve the right to modify these terms at any time; changes will take effect immediately upon posting on this page.

2. Digital Products and Studio Services

The Studio section offers downloadable digital products (Adobe Audition presets, PDF guides, tutorials, courses) acquired through a one-time payment via PayPal.

Digital products are delivered via an immediate download link after payment confirmation.
Access to purchased content is personal and non-transferable.
Reselling, redistributing, or publicly sharing purchased products is not permitted.

3. No Refund Policy

Due to the nature of digital products (downloadable and intangible), no refunds are issued once the product has been delivered and/or downloaded. By making a purchase, you expressly agree to this policy.

If you experience technical issues with the download, contact us at tmchpodcast@gmail.com and we will do our best to resolve it.
No refunds will be made for software incompatibility (Adobe Audition versions, operating system, etc.).
In the event of a billing error (duplicate charge or incorrect amount), we will review the case individually and proceed accordingly.

4. Payment Processing

All payments in the Studio section are processed exclusively through PayPal. We do not store credit or debit card data. By making a purchase, you agree to PayPal's terms and conditions. The Site is not responsible for errors in payment processing attributable to PayPal.

5. User Responsibilities

As a user of the Site, you agree to:

Provide truthful and current information when making a purchase or subscription.
Not use the Site for illegal or unauthorized activities.
Not attempt to breach the Site's security or access restricted areas without authorization.
Not reproduce, distribute, or modify the Site's content without express authorization.

Reproduction, distribution, public display, modification, or creation of derivative works without prior written authorization is not permitted.
Purchasing a digital product grants you a personal use license, not a transfer of intellectual property rights.

7. Limitation of Liability

To the maximum extent permitted by applicable law, TMCH Viajes — Uruguay and its operators shall not be liable for:

Direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Site or its products.
Loss of data, revenue, profits, or anticipated savings.
Errors or omissions in the Site's content.

We have no control over the content, privacy policies, or practices of these sites and assume no responsibility for them. 9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Oriental Republic of Uruguay. Any dispute arising in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Montevideo, Uruguay.

11. Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of TMCH Podcast shall be resolved exclusively by binding individual arbitration in Montevideo, Uruguay. You expressly waive your right to a jury trial.

13. Class Action Waiver

14. Indemnification

TMCH Viajes — Uruguay shall not be held liable for any delays, failures, or damages caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, pandemics, power outages, internet service disruptions, and third-party service failures.
